  • Boeing getting sued for "design faults"

    A US family who survived a plane crash that killed 40 people in Peru last month is planning to sue plane maker Boeing for unspecified damages, alleging a design fault, their lawyer said.

    Manuel von Ribbeck, representing the Vivas family of New York state, told CPN radio the suit would be filed next week in Chicago, Boeing's corporate home. He declined to discuss how much the Vivas family was seeking in damages.

    "There is a series of design and manufacturing flaws in this plane which make the company responsible, even if that did not cause the accident," von Ribbeck said.

    The suit also will include United Airlines, which trained the crew, he said.

    Boeing spokeswoman Liz Verdier said she could not comment in detail until the company saw the suit but added: "We will address any allegations they present."

    No one was immediately available to comment at United or at the Peruvian state airline TANS, which operated the Boeing 737-200 plane that crashed on August 23.


    so if there is this "design fault" why haven't any others failed?

      What BS. They don't even know what went wrong. If there were indeed technical failures, thats not Boeing's fault. It's the airline's job to do maintenance.

      About the only thing I can think of that was a problem with 737's was the rudder problems. But Boeing issued a fix for that, and it's up to the airlines to fix them. The hundereds flying around the US everday show that there is nothing wrong with these birds as long as proper maintenance is performed. So suing Boeing is complete BS, Boeing wasn't the one operating the plane.

              Ridiculous, I wouldn't be surprised if these bet "plaintiffs" didn't even know the first thing about aviation.

              Might I add, if such a situation happened with Airbus there's no doubt we'd have the same two forum idiots jumping up and down rubbishing the manufacturer. Their silence is deafening.

                    Don't you just love the stupid warning labels that get put on products as a result of these lawsuits....

                    I had a can of peanuts the other day that had a disclaimer stating that the product was produced in a plant that processed peanuts, and may contain peanuts, peanut fragments, or peanut dust. NO SHIT SHERLOCK!

                          Come on... as if no one expected lawsuits like this. Every freaking time a plane is involved people get cash crazy and attorneys are never far behind. In this case I really hope that this lawsuit is dismissed quickly. Go ahead, sue United, they will never get the money, thye will only end up in debt fighting a battle that will never end. And as for Boeing, they have the strongest arguement of all. The 737 is the world's most popular passenger aircraft in service today, if it did this well then why aren't more just dropping out of the sky. What an idiot to file such a lawsuit. If i were UA or Boeing, I would file a harassment suit against the plaintiffs.

                            The best way to rid the U.S. and maybe the world of these frivolous lawsuits would be loser pays system. If your lawsuit is thrown out as being frivolous then you and your attorney get to pay ALL of the lawyer fees for everyone that you sued. The other option is the loser in court pays all of the cost of the trial. Maybe just the losing attorney should pay all of the cost and perhaps lose their law license for awhile.

                              I thoguht that already happened...If you lose you had to pay the other parties fees...

                              I don't see why lawyers would have to pay though. Someone doesn't HAVE to hire them. They can say no. If they let themselves get talked into a lawsuit that is frivolous, it's their own fault. I always thought those "If we don't win, you don't pay" commercials sounded a little silly though. It's almost an invitation for stupid people to grab the phone and call.
