Girl suspend for wearing "barbie is Lesbian" shirt

    something written somewhere is considered speech. under freedom of speech it cant be unconstituitonal, even if it was racist or sexist or anything else. and just the words of barbie being lesbian are not "pornographic" and therefore nothing legally speaks against running around with it. unless its pornographic content, which does at least have a very limited legally defined meaning in europe being the visible sexual interaction between genitals, nothing speaks against running around with it in public.
    of course some ppl might not see it as ideal seeing peers of their kids run around with tshirts that say "KEN IS A FAG" or something, but that doesnt allow them to make their own laws that are supposed to overwrite constituional rights that are even valid for murderes and felons(at least in europe) except very severe cases of mass murder and sexual crimes.
    all and all i have to conclude that its just another result of stupid religious thinking that is sadly still a big concern in public matters in the us of a.

      Of course the constitution still applies to schools...but schools also have rights, too. It is their building, and if they think something is distracting the student body or may be offensive to someone, they have a right to do something about it. Its not "stupid religious thinking," its the law. School is a privelege...

          No, schoolwise, Europe and the US are the same, but school is a privelege everywhere, just like cars and airplanes are. They are all things that most countries have but take for granted, sure, everyone could get along without school, but then everyone would be dumber than a doorknob. Think about the countries that don't have schools...

              The right of free speech does not allow you to interfere with the education of other students. When someone comes to school wearing an item of clothing designed to provoke then they cause all the other students to suffer a less effective educational experience.

              I have to side with the school on this one. The girl was simply in the wrong regardless of what some shyster lawyer or left wing group might think. Individual rights do not take precedence over the majority's rights.

                How come a 14-year-old girl can proclaim herself a lesbian??? At that age, you have sexual orientation issues (doubts, experimentation), but having one's sexual orientation defined at 14??? She's either a VERY secure lady or she's certifiable.                     School may be a privilege and stuff but it plain sucks and they dont take any constitution for counted even if they say so, I got kicked out from some fuck**ng school last year for something like that....and damn, I wore my uniform and stuff, just thought in a different way.

                    Damn, the only thing left is teachers hitting us students with a ruler a la old way....

                      Omg, this girl isn't going around saying she has sex with other girls. She is saying she's gay, they are completely different things. A sexuality comes naturally to a person, she probably never felt any attraction to boys,and maybe never will. That doesn't mean she's dyking out every weekend with other girls. It just means girls are what she is attracted to. By your definition every person who has decided to be straight at 14 must also be having sex! Basicly, you would have to be insane to find a girl wearing rainbow coloured hair braid things "offensive". The shirt doesn't even say anything offensive. It is just a witty comment on a shirt....it's not like the shirt says something like "Barbie licks Jane's *****".

                            Was this because they were considered a homosexual symbol (aka rainbow flag)?

                            And what sort of distraction is *Barbie is a Lesbian*?

                            Is that construing that being a lesbian is controversial and unacceptable?

                            I think there is way more to this story and it hinges on the *rainbow beads*.

                            I read discrimination all over this by someone overzealous.

                            Imagine the torment the poor girl has suffered from as a result of her trying to identify with her inner feelings and having people treat as such because of it?

                            The sooner we educate our kids it's OK to be gay, that it makes not a scrap of difference to who you are or what you want to achieve in life, the better off society will be in general. And the end of these types of lawsuits.

                            Whilst I am not in favour of willy nilly law suits about nothing, if this goes to court and the girl is awarded damamges from the school then it should act as a precedent against discrimination against gays and lesbians in schools.

                            It's pretty sad we have to hit people in the hip pocket to get equality.

                              I don't think she wore the shirt to make a statement, or to show that she was a lesbian.

                              I think she just wore it because it was a shirt that she thought looked good - I don't think she was real serious about what was written on the shirt.

                                Hahahaha! Discrimination- no. The same thing would have happened if she wore a shirt that said, "Barbie likes to have sex with Ken." I don't feel sorry for her at all, I'm glad she was kicked out; it sends a message- you mess with the rules, you're gone...
